TERMS OF SERVICE: TRIGGER.ONLINE

Please review these terms (the "Agreement") carefully. By accessing or using the services offered by Trigger Online ("Trigger", "we", "us" or "our"), you are confirming that you have read, understand, and accept this Agreement.
1. The Services
1.1 Access. Subject to this Agreement and the plan you subscribed to, we grant you a non-exclusive, non-transferable, revocable right to access and use our websites, mobile applications, and automation tools (collectively, the "Services").
1.2 Evolution of Services. The Services evolve constantly. We may change, add, or remove features at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services.
1.3 Automated Use Prohibited. You may not access the Services in any unauthorized way, such as using external robots, spiders, or scraping technologies against our infrastructure.
2. Third-Party Services & Social Networks
2.1 Interdependency. The Services interact with "Third-Party Services" (such as Meta/Instagram, Facebook, X, and Google). Our Services depend on the continued availability of these platforms and their APIs.
2.2 No Control over Third Parties. We do not control Third-Party Services. If a Social Network stops making features or data available to us on reasonable terms, we may stop providing access to those features without liability to you.
2.3 Risk of Account Enforcement. You acknowledge that Social Networks (like Instagram) use automated systems to monitor account activity. Trigger is not responsible for, and shall not be liable for, any enforcement actions taken by a Social Network against your account, including but not limited to: shadowbans, temporary blocks, "checkpointing," or permanent deactivation. Use of automation features is at your own risk.
2.4 Third-Party Terms. By connecting a Social Network to Trigger, you agree to comply with that platform's specific terms (e.g., Instagram Terms of Use).
3. Your Account & Content
3.1 Responsibility. You are solely responsible for the activity that occurs on your account and for the "Customer Content" you upload. You must maintain the security of your login credentials.
3.2 Content License. You retain ownership of your Content. However, you grant Trigger a worldwide, royalty-free license to host, copy, and display your Content solely for the purpose of providing the Services to you.
3.3 Prohibited Content. You may not use the Services to distribute content that is unlawful, offensive, or violates the intellectual property rights of others.
4. Acceptable Use Rules
You agree to comply with all applicable laws and the following rules:
No Spam: You will not use Trigger to send unsolicited commercial communications.
No Malicious Activity: You will not upload viruses or attempt to interfere with the security of the Services.
Compliance: You will not use the Services for unauthorized surveillance or to violate the privacy of others.
Rate Limits: You will not attempt to circumvent any rate limits or "anti-spam" protections implemented by Trigger or the connected Social Networks.
5. Fees and Auto-Renewal
5.1 Payment. You must pay all fees for the plan you purchase. All fees are nonrefundable.
5.2 Auto-Renewal. Paid plans will renew automatically at the end of the term (monthly or annually) unless you cancel or downgrade your plan through your account settings prior to the renewal date.
5.3 Taxes. You are responsible for all applicable taxes based on your billing location.
6. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS." TO THE FULLEST EXTENT PERMITTED BY LAW, TRIGGER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, ACCURATE, OR ERROR-FREE. USE THE SERVICES AT YOUR OWN RISK.
7. Limitation of Liability
7.1 Indirect Damages. Under no circumstances will Trigger be liable for any indirect, punitive, incidental, or consequential damages, including loss of profits, data, or account access.
7.2 Specific Platform Liability. Trigger shall not be liable for any damages resulting from hacking, tampering, or the actions of Social Networks (e.g., Meta/Instagram) regarding your account status.
7.3 Aggregate Liability. Trigger's total liability for all claims arising out of this Agreement shall not exceed the greater of: (a) the fees paid by you to Trigger in the three (3) months preceding the claim; or (b) USD $100.
8. Indemnification
You agree to indemnify and hold harmless Trigger and its officers, directors, and employees from any claims, losses, or legal fees related to: (a) your Customer Content; (b) your breach of this Agreement; or (c) your violation of any Third-Party Service terms.
9. Termination
We reserve the right to refuse service to anyone and may suspend or terminate your access to the Services at any time, without notice, if we believe you have violated this Agreement or the rules of a connected Social Network.
10. Governing Law & Disputes
10.1 Governing Law. This Agreement is governed by the laws of The Netherlands.
10.2 Arbitration. Any dispute arising out of this Agreement shall be resolved by binding, confidential arbitration in Rotterdam, rather than in court. Both parties waive any right to a trial by jury or to participate in a class-action lawsuit.
